The Supreme Court on 7th October agreed to hear the pleas challenging the 2023 law on appointing the Chief Election Commissioner and Election Commissioners before a larger Constitution bench.
Justice Satish Sharma and Dipankar Datta have separate opinions on the appointment of the Election Commissioners. This petition challenges the 2023 law, which excludes the Chief Justice of India from this panel that selects the ECs, and the CEC (Chief Election Commissioner) must be referred to a larger Constitution bench. There were differences of opinion among the bench, and the constituting matter should be presented in front of effective bench and an authoritative decision should be placed before the Chief Justice of India.
The bench of Justice Joymalya Bagchi, Chief Justice, and Justice Mohana was informed by Gopal Sankaranarayanan, senior lawyer, about the reversed decision of the petition, in which the CJI said we will consider and decide what to do.
